Director Disqualification

Being disqualified from acting as a director can have serious consequences for both your personal and business lives. It’s vital to take legal advice as early as possible. Disqualification occurs as a result of an investigation by the insolvency service. If they think you have failed in your duties as a director by:

  • Trading while insolvent
  • Failing to keep accurate accounts
  • Failing to send accounts and returns to Companies House
  • Not paying tax
  • Using company finances or assets for your own personal benefit

If any of these apply, the Insolvency Service will initiate disqualification proceedings and issue a pre-action letter. At this stage, you should contact Beltrami & Co without delay. There are two options at this stage: You can wait for the insolvency service to begin court proceedings or you can issue a ‘disqualification undertaking’. This means you voluntarily withdraw from acting as a director and court action against you ceases. Beltrami & company can advise you on the best option and the best course of action.
