If the police have detained you (or one of your family members), they must either release or arrest you within 12 hours. However, this can be extended to 24 hours without the court’s permission by a Police Custody Review Officer.
What happens if you are arrested?
If you have been arrested, you will either be kept in custody until the next court day or released and ordered to appear in court on a specified day.
If a report is sent to the Procurator Fiscal, the police may release you. The Procurator Fiscal will then decide whether to prosecute you, and if they do bring criminal proceedings against you, you will be given a date to attend a court hearing.
