Divorce Lawyers in Glasgow and Across Scotland
If your marriage has ended, our family law solicitors can guide you through divorce in Scotland from the first conversation to the final decree. We act for clients in Glasgow, Edinburgh and throughout Scotland, and we deal with the practical questions as well as the legal ones: where you will live, how your children are looked after and how your finances are divided.
To obtain a divorce in Scotland, the court must be satisfied that the marriage has broken down irretrievably. That can be shown in one of four ways: your spouse's adultery, your spouse's unreasonable behaviour, living apart for one year with your spouse's consent, or living apart for two years without it.
Dividing Money and Property on Divorce
Scots law aims for a fair division of the net value of the matrimonial property. That usually means the assets built up during the marriage, such as the family home, savings and pension rights. The starting point is that this value is shared fairly, which is often equally, although special circumstances can justify a different split. We can advise on what counts as matrimonial property in your case and what a fair outcome is likely to look like. See our guide to finances after separation.
Separating Parents and Children
Where there are children, their welfare comes first. We can help you agree and record arrangements for where your children live and how they spend time with each parent, and represent you in court if agreement cannot be reached. Read more about children in a separation.
Unmarried Couples
If you lived together but did not marry, you do not have the same rights as a married spouse, but you may still be able to make a financial claim against your former partner. Any such claim must be brought within one year of the date the relationship ended, and late claims are not generally accepted, so it is worth taking advice quickly. See our page on cohabitation rights.
